Judge Signals Legal Victory Ahead for Haitian and CHNV Migrants in Boston Court

 

In a major development today, U.S. District Judge Indira Talwani announced plans to block the federal government from terminating legal protections for over 500,000 migrants, including thousands of Haitians, who have benefitted from the CHNV humanitarian parole program, also known as the Biden Program.

The announcement came during a pivotal hearing in Boston on Thursday, April 10, where Judge Talwani stated she would act before the April 24 deadline to prevent the government from revoking the status of individuals who legally entered the U.S. through the program.

Although no final ruling has been issued yet, the judge made her intentions clear: she will certify the lawsuit as a class action for all CHNV recipients and halt the Biden-era program’s termination, which was announced in March by the Department of Homeland Security (DHS) under the current administration.

The case, Svitlana Doe v. Noem, was brought forward by the Haitian Bridge Alliance along with plaintiffs from Haiti, Cuba, Nicaragua, and Venezuela. Legal backing was provided by Justice Action Center and Human Rights First, who argue that canceling the CHNV program is not only unlawful but puts thousands at risk of mass deportation, despite their full compliance with immigration procedures.

During the hearing, Judge Talwani questioned the government’s legal reasoning and political motivations behind ending the program. She strongly criticized the mischaracterization of CHNV recipients as “illegal,” pointing out that the law being cited was originally intended for individuals who entered the country without authorization—not those who were lawfully paroled into the U.S. under humanitarian grounds.

Judge Talwani’s forthcoming decision is expected to provide critical relief to hundreds of thousands of families, particularly Haitians fleeing violence, political turmoil, and economic collapse.
